Winnipeg woman sues pickleball organization after fracturing wrist, sustaining concussion Lawsuit says she collided with 'hidden metal bars' alongside window court A Winnipeg woman is suing an indoor pickleball organization after she collided with "hidden metal bars" while playing on an indoor court, suffering a fractured wrist and a concussion. Manivone Morrison filed a statement of claim in Manitoba's Court of King's Bench on Wednesday. She alleges the Winnipeg South Pickleball Club Inc., which owns the premises commonly known as the Picklr Winnipeg South, breached its duties of care. The lawsuit alleges the business created a hazard and failed to place padding over the metal bars or put up signs warning players of the danger. The lawsuit also alleges the defendant failed to provide verbal or written warning to the players or provide a safe sporting area, as the metal bars did not present a common risk to pickleball players. "My client believes this is not a safe setup and that contributed to her injury," Jacob Love, Morrison's legal counsel, told CBC News. The defendant says they are aware of the claim but are unable to comment at this time as the matter is before the courts. Morrison went to the facility on April 2 and was assigned a court by a window that was protected by steel bars and brackets that are covered by a black curtain, the lawsuit claims. While running after a ball, her forward momentum carried her into the bars, the statement of claim alleges. The lawsuit says the defendant should have or ought to have known the hidden metal bars presented a danger to players and that the danger was not foreseeable to Morrison. In addition to the fractured wrist and concussion, the lawsuit claims Morrison also has experienced sleep disturbances, decreased mobility and strength, and pain and frustration. Morrison is seeking damages, including costs for out-of-pocket medical expenses and the legal expenses of filing the claim, the lawsuit says. None of the allegations have been tested in court, and a statement of defence has not been filed.
