Northeast Omaha neighbors push back on concrete company’s truck traffic in residential area
OMAHA, Neb. (WOWT) - A dispute has been simmering in a northeast Omaha neighborhood. It boils down to whether an industrial site for heavy trucks belongs near homes with pets and kids.
Trucks on unpaved streets
Streets in this northeast Omaha neighborhood are not paved, and trucks passing homes have caused friction with neighbors like Makayla Johnson and Cori Bergantzel.
“This is not the area or the place for them. Families, pets,” Johnson and Bergantzel said.
Shawn Weers, co-owner of Fusion Concrete, says he has emailed drivers instructing them not to drive through the neighborhood anymore, which leaves Hartman Avenue as the only route for dump truck travel.
This stretch of Hartman Avenue in northeast Omaha is considered a substandard street, meaning the city is not doing much to maintain it. Neighbors say the truck traffic is compounding that problem.
After Fusion Concrete was contacted for this story, the company filled rough spots on the city street with asphalt grindings.
“Somebody came in and graded it, so it’s a lot better now,” said Cory Starks, a motorcycle rider.
Weers says the repair shows his intent to be a good neighbor. Not everyone agrees that is enough.
“I don’t want them going down my street for sure, but I don’t want them there period, because that’s residential. They’re not even supposed to be there,” said Lori Johnson, a neighbor.
A zoning conflict
Neighbors are correct that trucks are not supposed to be there. The city has given Fusion Concrete until Sept. 28 to move its equipment off the property.
Weers says he did not intentionally violate zoning regulations, relying instead on the county assessor’s classification of the property as industrial. That classification includes a disclaimer stating it is not a legal description. The city’s official zoning designation for the property is residential.
Weers says the company is working on a request for a zoning change. Neighbors plan to oppose it.
“This is all residential and there’s a lot of kids down here, homes, and they’re treating it like a major city street, and it’s not,” said David Johnson, a neighbor.
City contracts and street repairs
Fusion Concrete’s work includes city contracts for projects such as a recent one in West Omaha. Weers says he wants to help improve Hartman Avenue in front of his property by sharing the cost of paving it. Neighbor Kathy Misek, who lives across the street, says she cannot afford to join him.
“Take care of the street you tore up. It’s way, way worse than it was,” Misek said.
What comes next
While a request to change zoning on the lot from residential to industrial may be forthcoming, neighbors say filling potholes on Hartman Avenue has not resolved their objections to the company’s presence.
Weers says he proactively contacted city officials to better understand the property’s status and begin a rezoning request. If accepted, that request could delay the city’s deadline for clearing the lot. However, because the company holds city contracts, the planning director and Mayor Ewing say they take the zoning violation seriously.
