Kevin Hart says in new court papers that he paid more than $100,000 to a former personal assistant as part of a non-disclosure agreement when she left his company, Hartbeat Productions LLC, in 2020.
In a hearing scheduled Sept. 9, Hart is asking Los Angeles Superior Court Judge Steven A. Ellis to find the ex-aide, Miesha Shakes, in breach of contract. In previous court papers, Hart’s attorney Donte O. Mills stated that the “undisputed material facts” show defendant Shakes and her former boss were parties to the NDA that Shakes allegedly breached by participating in an interview.
“Commencing in or around August, 2020, through August, 2021, I instructed personnel working at my direction to cause payments to be sent to Ms. Shakes in order to pay amounts due under the NDA…,” according to Hart, whose declaration includes a chart of payments that eventually totaled $102,975.
Mills further says Hart will seek compensation for his attorneys’ fees, costs and expenses regarding the non-disclosure agreement.
In a previous sworn declaration in support of the breach-of-contract motion, Hart says Shakes was “privy to certain confidential business and personal information regarding me, my family, friends, associates and personnel at Hartbeat and other companies” with which the entertainer is affiliated.
Working in the entertainment industry, Hart’s livelihood depends in part on his reputation and the public’s perception of him, particularly in light of the fact he is involved in a number of family-oriented projects, according to the declaration, in which Hart also says he endorses various national brands and those endorsement deals depend in part on public perception of his reputation.
“I have therefore suffered harm as a result of the interview’s publication and Shakes’ dissemination of confidential Information,” Hart says, estimating the harm at about $50,000.
Hart’s suit, originally filed in December 2023 and amended a month later, involves a social media conversation between Shakes and Latasha Transrina Kebe, who also is known as Tasha K. Hart previously settled the part of the case with Kebe and no terms were divulged.
In their court papers, the 47-year-old Hart’s attorneys maintain their client and his company suffered “irreparable harm from the continued publication and broadcasting of the interview and related content, which includes defamatory statements, including false statements regarding Hart’s supposed criminal conduct, which are damaging to his reputation and thereby to his livelihood as a performer.”
In her own sworn statement, Shakes alleges that Hart is suing to prevent her from exercising her constitutional rights and to silence her speech.
“However, (Hart’s) own evidence demonstrates that numerous factual disputes remain unresolved and should: be decided by a jury rather than by (Hart’s dismissal motion),” Shakes says.
According to Shakes, an NDA does not cover criminal acts and she contends that she has been threatened by Hart and his team since Hart allegedly tried to blackball her from Hollywood in August 2020. Shakes further states that she has continued to receive threats from Hart, his attorneys and others, including by Hart’s filing of his lawsuit.
Hart’s other claims against Shakes include defamation and invasion of privacy. Trial is scheduled Oct. 12.
