Hendersonville sues housing developer over unfinished infrastructure
HENDERSONVILLE, Tenn. (WZTV) — The City of Hendersonville has filed a lawsuit against a developer of a housing development, alleging required public infrastructure improvements were not completed.
The lawsuit names Eagle View, LLC and developer Siddharth Amin. The development, named Eagle View, is located on New Shackle Island Road in Hendersonville near Glenbrook Shopping Mall.
According to a city news release issued Aug. 13, the lawsuit stems from the developer's alleged failure to complete infrastructure improvements required as part of the approved development.
What does the city say happened?
The city alleges the developer abandoned the project before completing required improvements.
Those improvements include work involving:
- Roadways
- Stormwater infrastructure
- The development's entrance bridge and culvert
The city says the improvements were required under the development agreement and are intended to serve the development.
Hendersonville officials say the unfinished work is a concern because the infrastructure is necessary for public safety, adequate access and compliance with applicable engineering and construction standards.
The city also alleges the financial surety provided for the project is not enough to cover the cost of completing the remaining work.
A surety is financial security intended to help ensure that required work is completed if a developer does not fulfill its obligations.

What is the city seeking?
The lawsuit seeks damages and other relief that the city says would allow it to complete the required infrastructure and protect the city's interests.
The city says the lawsuit is part of its broader effort to hold developers accountable for commitments made during the development approval process.
Hendersonville Mayor Jamie Clary said the city intends to enforce those obligations.
"These commitments exist to protect the public and ensure that necessary infrastructure is completed," Clary said in the city's release.
Clary also said residents should not be responsible for costs associated with commitments he says the developer accepted.

As of Friday, Aug. 14, we had not received a response from Amin.
The city has filed the lawsuit, but the allegations against Amin and Eagle View have not been established as fact in court.
